Talk About Therapy. THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Your rights
You have these rights over your child's health information. In this notice, "you" means the patient, or the parent or legal guardian who acts for a child.
- Get a copy of your records. You can see or get an electronic or paper copy of your child's medical and billing records, or ask us to send a copy to someone you choose. We will usually provide a copy or a summary within 30 days of your request. We may charge a reasonable, cost-based fee.
- Ask us to correct your records. You can ask us to correct information you think is incorrect or incomplete. We may say "no," but we will tell you why in writing within 60 days.
- Ask for confidential communications. You can ask us to contact you a certain way, such as only by cell phone, or to send mail to a different address. We will say "yes" to all reasonable requests and will not ask why.
- Ask us to limit what we use or share. You can ask us not to use or share certain information for treatment, payment or our operations. We are not required to agree, and we may say "no" if it would affect your child's care.
- Keep self-paid care from your health plan. If you pay for a service or item in full out of pocket, you can ask us not to share that information with your health insurer for payment or our operations. We will say "yes" unless a law requires us to share it.
- Get a list of who we've shared information with. You can ask for a list of the times we shared your child's information in the six years before your request, who we shared it with, and why. It includes every disclosure except those for treatment, payment and our operations, and certain others, such as ones you asked us to make. We provide one list a year free and may charge a reasonable, cost-based fee for another within 12 months.
- Get a copy of this notice. You can ask for a paper copy at any time, even if you agreed to receive it electronically.
- Choose someone to act for you. A legal guardian or someone with legal authority can use these rights for your child. We will check that the person has this authority before we act.
- Be told about a breach. We will let you know if a breach occurs that may have compromised the privacy or security of your child's information.
- File a complaint. If you feel your rights were violated, contact our Privacy Officer (see How to reach us). You can also complain to the U.S. Department of Health and Human Services, Office for Civil Rights: 200 Independence Avenue, S.W., Washington, D.C. 20201; 1-877-696-6775; or www.hhs.gov/ocr/complaints. We will not retaliate against you for filing a complaint.
To use any of these rights, ask at the front desk or contact our Privacy Officer. Some requests must be in writing.
Your choices
For some sharing, you decide. Tell us your preference.
- Family, friends and caregivers. We may share information with people involved in your child's care, such as a grandparent who brings your child to sessions, unless you tell us not to.
- Disaster relief. We may share information with relief organizations in a disaster, unless you tell us not to.
- Updates after sessions. Your child's therapist may give you updates regarding your child's therapy in the waiting area. If you would rather talk in private, tell us and we will use a private area.
- Therapy by video or outside our office. People near you may hear parts of the session. Tell us if you want us to avoid discussing details in front of anyone.
If you can't tell us your preference, for example in an emergency, we may share information if we believe it is in your child's best interest. We may also share information when needed to lessen a serious and imminent threat to health or safety.
We never share your information for these purposes without your written permission:
- Marketing
- Selling your information
- Most sharing of psychotherapy notes
How we use and share your information
We typically use or share your child's health information to treat your child, run our practice and get paid.
- Treat your child. We share information with others treating your child. For example, your child's speech and occupational therapists compare notes, or we send an evaluation to your pediatrician.
- Coordinate care. We may share information with the person or program that referred your child, such as an early intervention service coordinator, and with your health plan's care manager.
- Run our practice. We use information to run our practice, improve care and contact you. For example, we send appointment reminders by phone, text or email to the contact details you give us, and we review the quality of our therapists' work.
- Bill for services. We share information to get paid by health plans, Medicaid and other payers. For example, we tell your child's health plan about a therapy session so it pays us.
- Companies that help us. We use companies for services such as our records, billing and phone systems.
The law also allows or requires us to share information in other ways, usually for the public good, such as public health and research. We must meet the law's conditions before we share for these purposes.
- Public health and safety: preventing disease, reporting suspected child abuse or neglect as Georgia law requires, reporting reactions to medicines or products, and preventing a serious threat to anyone's health or safety.
- Research: under conditions the law sets, such as approval by a review board or removing details that identify your child.
- Following the law: including when the U.S. Department of Health and Human Services checks that we comply with federal privacy law.
- Organ and tissue donation requests, medical examiners and funeral directors.
- Government requests: workers' compensation claims, health oversight agencies such as licensing boards and auditors, law enforcement, and special government functions such as military and national security.
- Lawsuits and legal actions: in response to a court or administrative order, or a subpoena.
If we share information with someone who is not covered by federal privacy law, they may share it again, and it may no longer be protected by that law.
Any other use or sharing not described in this notice needs your written permission. You can take that permission back at any time by telling us in writing.
Children, parents and Georgia law
Parents and legal guardians usually act for their children and can use the rights in this notice for them.
- Parents and guardians. A parent or legal guardian usually makes choices about a minor's health information and can see the child's records.
- Separated or divorced parents. Each parent may usually see the child's records, unless a court order limits it. Please give us a copy of any custody order or court order that applies.
- Exceptions. Sometimes the law lets a minor make their own decisions about certain care, or lets us limit a person's access to protect the child. When that happens, we follow the law.
- At 18. When your child turns 18, these rights pass to them.
Georgia law. Georgia law gives some information more protection than federal law does, such as information about HIV/AIDS, mental health, genetic testing or substance use treatment. When it does, we follow the stricter law.
Our responsibilities
The law requires us to protect your child's health information and to follow this notice.
- We must keep your child's health information private and secure, and give you this notice of our legal duties and privacy practices.
- We will let you know promptly if a breach occurs that may have compromised the privacy or security of your child's information.
- We must follow the duties and practices in this notice and give you a copy of it.
- We will not use or share your information other than as described here unless you tell us we can in writing. You can change your mind at any time by telling us in writing.
This notice applies to all Talk About Therapy offices (Smyrna/Vinings, North Druid Hills and Marietta) and to our therapists, staff, students and trainees.
Changes to this notice. We can change this notice, and the changes will apply to all the information we have about your child. The current notice is available on request, in each of our offices and on our website.
